Hey. Sorry to hear, but when you wrote the seller is lost too, do you mean that he's not responding? Well, since you bought it through eBay, then file a complaint. The seller will have to provide proof that he sent the item. If you go through eBay, you should get your money back. Also, Paypal will protect you too, if you used their service.

Who did you get this from ? as i just had a similar experience and i tracked the guy down and managed to get a refund. I think this may have been one of his pieces for sale. Was it Fitzandthefool ?

I bought a Kubert from him. he said he sent it, so i waited and waited, with a couple of days left i lodged a claim with paypal. his name was Hadrian Lebeau. i will mail you all the details i have. plus i will post the piece i was supposed to have been sent as a warning to others.

Yeah, that situation really blows. So far I haven't had any art go (permanently) missing, but I did have a sketchy seller try to bone me on a deal for some DC figures. Never buy from someone who doesn't have a good feedback history.
