MARVEL VS. JOE SIMON FEDERAL COURT CASE
2001
Joe Simon created (or co-created) Captain America in 1940. He fought for ownership of the character decades later. Marvel sued Simon in federal court to retain ownership of the character. Marvel presented evidence to support their claim that Simon traditionally worked for comic book publishers to produce characters for the various companies. Marvel alleged that Simon never established ownership of his characters and cited a drawing of Blue Bolt, Simon took credit for the character’s invention for another publisher. Marvel obtained this Blue Bolt drawing and entered it into evidence in court (I have been unable to determine the origin of the drawing, but the court accepted this as Simon’s hand). The result was Marvel retained control of Captain America.
I acquired the drawing from a customer of mine in 2010.
